Varanasi: A city court has dismissed a plea seeking registration of case case against Samajwadi Party president Akhilesh Yadav and All India Majlis-e-Ittehadul Muslimeen (AIMIM) chief Asaduddin Owaisi over their alleged derogatory remarks about a ‘Shivling’ allegedly found inside the Gyanvapi mosque complex.
Petitioner sought registration of FIR against Yadav, Owaisi
Petitioner advocate Harishankar Pandey had moved the for registration of a First Information Report (FIR) against Yadav, Owaisi and others for hurting Hindu sentiments.
Pandey argued before the court that Yadav and Owaisi, along with the Anjuman Intezamia Masjid Committee and approximately 2000 unidentified persons, had repeatedly referred to the ‘Shivling’ found inside the Gyanvapi mosque complex as a fountain causing significant offense to the sentiments of Hindus and sought registration of FIR against them.
Pandey indicated he would move High Court against the order
The court of Senior Judge Civil Division Vinod Kumar Singh, after hearing submissions, Pandey’s plea for registration of FIR.
“The court of Senior Judge Civil Division Vinod Kumar Singh rejected the plea for an FIR to be registered against the accused parties. The matter was heard in the court on Tuesday but we received the order of the copy on Wednesday,” Pandey told news agency PTI and indicated that he would challenge the court’s order before the Allahabad High Court.
A magistrate court earlier dismissed Pandey’s plea
Pandey had earlier filed a plea in this regard before a magistrate court, which had rejected his plea, saying that the primary responsibility of law and order lies with the state and its agencies and it is not that they were not aware that whether the alleged statements in question were made or not and if they haven’t found any law and order issue and incitement of violence, then it is not desirable to interfere with the decision of the state and its agencies.
Pandey had also said that he had also written a letter in this regard to the authorities concerned and had also met police officials urging action against Yadav, Owaisi and others, however, no action was taken against them for their alleged objectionable statements.
