New Delhi: A 10-year-old boy was booked for alleged rioting and attempt to murder among other provisions of the Bharatiya Nyaya Sanhita (BNS). Police in Etah district of Uttar Pradesh imposed the charges on the Class 6 student after a dispute over the installation of a water tap, Times of India reported.
However, the boy’s family members approached the Etah superintendent of police (SP), and claimed that the cops lodged the FIR without carrying out any primary probe and didn’t consider the complaint filed by them.
Additional superintendent of police (ASP) Rajkumar Singh pointed out that the accused’s ages were not mentioned in the complaint, and this is why the boy was named in the FIR. He added the child’s name would be struck off from the FIR after further investigation. He also ordered the police station to make the necessary amendments.
According to legal experts, under the recently-enacted BNS, the police are supposed to carry out a primary investigation in complaints related to non-heinous crimes before filing an FIR. They said in this case, it appears that the cops registered the FIR without checking the facts.
What was the incident?
The incident happened in Jaithara town on September 17. A clash erupted between two groups over installation of a water tap in the area. Both the warring parties lodged written complaints against each other to the police. They demanded FIR to be registered.
The boy’s family members raised allegations that the cops only filed an FIR against one side, in which they named the child’s father and seven others, including four women. The 10-year-old boy was booked under BNS sections 191 (rioting), 333 (house-trespass after preparation for hurt, assault or wrongful restraint), 352 (intentional insult to provoke breach of peace), 76 (physical assault or the use of criminal force against a woman), 115(2) (voluntary causing hurt), 351(3) (criminal intimidation) and 109 (attempt to murder).
