New Delhi: The Delhi High Court on Tuesday (December 10) granted 10-day interim bail on medical grounds to expelled Bharatiya Janata Party (BJP) leader Kuldeep Singh Sengar seeking suspension of his 10-imprisonment awarded to him for the custodial death of the father of the Unnao rape victim.
A division bench of the High Court on December 5 granted two-week interim bail on medical grounds to Sengar in the case of raping a minor in Unnao, Uttar Pradesh in 2017 and had put an interim suspension on his sentence.
Single bench partly allowed Sengar’s plea
Justice Manoj Kumar Ohri partly allowed the plea of Sengar and suspended his sentence for the time being, noting that a similar relief was granted to him by the division bench of the high court in the rape case against him.
The High Court was informed that Sengar approached the division bench of the High Court seeking an interim suspension of his sentence in the rape case on medical grounds.
“The application (by Sengar) is partly allowed and the appellant (Sengar) is directed to be released on interim bail till December 20 on furnishing a personal bond of Rs 50,000 and a surety of the like amount,” the single bench said while imposing the same conditions on him as imposed by the division bench while granting him two-week interim relief.
What did division bench direct while granting relief to Sengar?
The division bench, while granting relief to Sengar, directed that he be admitted to All India Institute of Medical Sciences (AIIMS), Delhi for his medical evaluation and also sought a report from the medical board of AIIMS.
Sengar was convicted in the case of death of victim’s father
Sengar was sentenced 10 years of rigorous imprisonment in the case of the death of the rape victim’s father in custody. The father of the Unnao rape victim was arrested at the behest of Sengar in a case under Arms Act and he died on April 9, 2018, while in judicial custody. The trial court had also awarded a 10-year jail term to Sengar’s brother Atul Singh Sengar and five others.
Sengar was sentenced to undergo imprisonment for remainder of his biological life for raping a minor
A Delhi court convicted Sengar for raping a minor and sentenced him to undergo imprisonment for the remainder of his biological life, saying that that he was a public servant and people had reposed their faith in him but he had betrayed their trust.
The Unnao rape case and related cases were transferred to Delhi from the trial court in Uttar Pradesh on the directions of the Supreme Court on August 1, 2019.
