New Delhi: The Delhi High Court on Monday (February 3) granted one-day interim bail to Kuldeep Singh Sengar, a convict in the main Unnao rape and a related case, on the medical ground till February 4.
A bench comprising Justice Yashwant Varma and Justice Harish Vaidyanathan Shankar allowed Sengar one-day medical bail to undergo cataract surgery on February 4.
High Court directed Sengar to surrender on February 5
The High Court directed Sengar to surrender before the authorities concerned on February 5.
The High Court earlier on January 22 had also granted Sengar interim bail to undergo his eye surgery at AIIMS, Delhi, however, the eye surgery could not be conducted. Sengar’s counsel informed the High Court that he has returned back to Tihar Jail due to the unavailability of the surgeon who was supposed to perform his eye surgery.
Sengar’s counsel further had submitted before the bench that he would approach the court again either on January 28 or 29 to seek interim bail on medical grounds to undergo cataract surgery.
Sengar is serving life imprisonment in main Unnao rape case
Sengar is serving life imprisonment for the remainder of his biological life in the main Unnao rape case for allegedly kidnapping and raping a minor girl in 2017 and he has challenged the trial order of the trial court before the High Court.
Sengar is also serving 10-year jail term in a connected case
Sengar is also serving a 10-year jail term in a connected case of the death of the Unnao rape victim’s father in custody. He has also approached the High Court seeking suspension of his sentence in the case.
High Court on January 20 refused to extend Sengar’s plea for interim bail
The High Court had in December last year granted two-week interim bail to Sengar on medical grounds and it was subsequently extended by another month. The High Court, however, refused to extend Sengar’s earlier granted interim on January 20 and directed him to surrender, taking note that the copy of his petition seeking extension of his interim bail was not supplied to the victim. Later, it granted him interim bail on medical grounds on January 22.
