New Delhi: The Supreme Court on Monday (December 9) issued notice to the Central Bureau of Investigation (CBI) on a plea filed by former media executive Indrani Mukerjea, who is accused of killing her daughter Sheena Bora in 2012, challenging an order of the Bombay High Court denying her permission to travel abroad.
A bench comprising Justice MM Sundresh and Justice Aravind Kumar issued a notice to the CBI and sought its response on Mukerjea’s plea against the order of the High Court.
What has Indrani Mukerjea submitted?
Mukerjea has said in her plea that she was a British citizen and she needs to visit the United Kingdom and Spain for making necessary changes and amendments and taking care of pending work which cannot be transacted without her personal presence and that her presence was necessary for the activation of a digital certificate, which was a must for all relevant work and administration in Spain.
A special court hearing Indrani Mukerjea’s plea had allowed her plea on July 19 with certain conditions to travel to Spain and the United Kingdom for ten days between intermittent period over three months with certain conditions.
CBI challenged special court order before High Court
Aggrieved the special court order, the central agency, which has investigated the Sheena Bora murder case, challenged the order trial court order granting her permission to visit abroad before the High Court.
There was a possibility of Indrani Mukerjea fleeing the country, CBI told High Court
CBI told the High Court that Indrani Mukerjea is a prime accused in the case of murder of her daughter and the case is ongoing in which she was facing trial for a serious offence and hence, it would not be appropriate to let her leave the country at this stage. The central agency had further said that there was a possibility of her fleeing the country if allowed to travel abroad.
High Court set aside special court order
The High Court set aside the order of the special court order, saying that it was not reasonable, and hence the same was unsustainable. The High Court had further said that if Indrani Mukerjea wants to perform the desired work from India, then the statutory authority concern shall help her.
Indrani Mukerjea was arrested in the murder case of her daughter in 2015
Indrani Mukerjea was arrested in the murder case of her daughter Sheena Bora in August 2015 and she is currently out on bail. She is facing trial for the alleged murder of her daughter before a special court. Peter Mukerjea, who is a former media baron and former husband of Indrani Mukerjea, was also arrested in the case for allegedly being a part of the conspiracy linked to the murder.
All accused in the Sheena Boa murder case are currently out on bail.
