New Delhi: The Enforcement Directorate (ED) on Thursday (November 28) told a city court that the sanction obtained to prosecute former Delhi Chief Minister Arvind Kejriwal in the excise policy-linked corruption case was broad enough to try him in the related excise policy-linked money laundering case.
The ED told this to Special Judge Kaveri Baweja in response to Kejriwal’s plea seeking a copy of the requisite sanction to prosecute him in the alleged money laundering case related to the now-defunct excise policy.
Kejriwal has moved court seeking a copy of requisite sanction to prosecute him in ED case
Kejriwal has moved the special court seeking a copy of the requisite sanction to prosecute him, claiming that he has not been served a copy of the sanction by the ED while pointing out that the central agency, during a hearing before the Delhi High Court on his plea, had stated before the High Court that it has got the requisite sanction to prosecute him in the alleged money laundering case.
Was relying on sanction accorded in predicate offence case, being probed by CBI: ED
The ED’s counsel submitted before the court on Thursday that it was relying on the sanction accorded in the predicate offence case, being probed by the Central Bureau of Investigation (CBI) based on which the money laundering case was filed, which was granted on August 14.
The ED counsel told the special court that the sanction in the corruption case is “broad enough to cover offences not only under the Prevention of Corruption Act (being probed by the CBI) but also in other offences or offences made out from the facts and circumstances as mentioned therein (in CBI case) and punishable under any other provision in law in respect of the said acts and for taking cognisance by the court,” news agency PTI reported.
Matter would be further heard on November 30
Kejriwal’s counsel then urged the special court to direct the ED to file a response and the ED did not oppose this.
“Accordingly, it is directed that a reply be filed to the aforesaid application (by Kejriwal) before the next date of hearing,” the Special Judge said and posted the matter for further hearing on November 30.
