Sambhal: The advocate commissioner, who was appointed by the local court to conduct a survey of the Shahi Jama Masjid here, did not present the survey report before the court and sought an extension for 15 days to submit the report citing ill health.
The civil court (senior division) is expected to take a decision on the extension plea by today.
Sambhal court on November 19 ordered survey of mosque by an advocate commissioner
The Sambhal court had on November 19 passed an ex-parte order on a plea filed by the Hindu side for the survey of the mosque by an advocate commissioner.
The court, while taking note of the submissions made by the Hindu side claiming claiming that the said mosque was built by Mughal emperor Babur in 1526 after demolishing a temple, said that it is probable that the survey report will facilitate the court in deciding the case and ordered ordering for the survey of the mosque.
What did the advocate commissioner say?
“Today I have moved the adjudication application in the court. The final report of the survey is ready and it is in the final stage. This report will be presented in a sealed envelope but due to health issues, I have asked for 15 days time from the court. I had fever for three-four days. I have not been able to analyse the report yet. The other party will file its objection. After hearing the objection, the court will give its decision at around 4 pm,” advocate commissioner Ramesh Singh Raghav told reporters on Monday, news agency PTI reported.
Protesting locals clashed with security personnel during a second round of survey of the mosque on November 24, which led to a major violence and leading to death of four people and injuries to dozens.
Supreme Court directed Sambhal court to halt proceedings
The Supreme Court, while hearing a plea filed by the Committee of Management, Shahi Jama Masjid, Sambhal challenging the Sambhal court order and seeking a stay on the order, directed the local court to halt proceedings in the case and not to pass any order in the matter related to survey of the mosque and not to open any survey report till the matter is heard by the appellate court.
