Sambhal: The advocate commissioner, who was appointed by the local court to conduct a survey of the Shahi Jama Masjid in Sambhal, on Monday (December 9) said that the survey report will be filed in the court in 15 days.
The advocate commissioner did not present the survey report before the local court and sought an extension for 15 days to submit the report citing ill health.
The survey report is expected to be filed by advocate commissioner Ramesh Singh Raghav within 15 days.
Sambhal court marked extension plea as ‘keep on file’
The civil court (senior division) while considering the extension plea by the advocate commissioner marked it as “keep on file”, Raghav said.
“I had asked for 15 days time from the honourable court but my application has been marked with ‘keep on file’ because the Supreme Court has given a stay order that the lower court will not pass any order. Now the date of January 6 is fixed in the high court and we will submit our report before 15 days,” news agency PTI quoted Raghav as saying.
Raghav further added, “This report will be presented in a sealed envelope but due to health issues, I have asked for 15 days time from the court. I had fever for three-four days. I have not been able to analyse the report yet.”
Raghav earlier in the day had moved the plea seeking extension of 15 days to file the survey report before the court.
Sambhal court on November 19 ordered survey of mosque by an advocate commissioner
The Sambhal court, while hearing a plea filed by the Hindu side seeking the survey of the mosque by an advocate commissioner, had on November 19 passed an ex-parte order and had ordered for the survey of the mosque.
The court, while taking note of the submissions made by the Hindu side, said that it is probable that the survey report will facilitate the court in deciding the case and ordered ordering for the survey of the mosque.
The Hindu side has claimed that claiming the Shahi Jama Masjid was built by Mughal emperor Babur in 1526 after demolishing a temple.
Supreme Court directed Sambhal court to halt proceedings
The Supreme Court, while hearing a plea filed by the Committee of Management, Shahi Jama Masjid, Sambhal challenging the Sambhal court order and seeking a stay on the order, directed the Sambhal court to halt proceedings in the case and not to pass any order in the matter related to survey of the mosque and not to open any survey report till the matter is heard by the appellate court.
