Kolkata: A designated Central Bureau of Investigation (CBI) court has refused to grant bail to Sandip Gosh, the former principal of RG Kar Medical College and Hospital where a woman doctor was rape and murdered on August 9, observing that the nature and gravity of allegations against him are grave and it can attract capital punishment if allegations are proved.
Court sent Ghosh, Mondal to judicial custody till September 30
Additional Chief Judicial Magistrate S Dey also denied bail to Abhijit Mondal, former officer in-charge of Tala police station, and granted the prayer of the CBI for judicial custody of Ghosh and Mondal till September 30.
Ghosh and Mondal were arrested by the CBI on September 14 for alleged tampering of evidence and delay in filing of First Information Report (FIR) in the rape and murder of the woman doctor at the seminar room of the RG Kar Medical College and Hospital on August 9.
What did Ghosh’s counsel submit?
The counsel appearing for Ghosh claimed before the court that the former principal was falsely implicated in the case and denied the allegations levelled against him, submitting that there was no act on his part to commit the crime as alleged.
Allegations against accused are grave and it may attract capital punishment if proved: Court
The designated CBI court said that the nature and gravity of the allegations against the accused are grave and if allegations are proved, it may attract capital punishment, which is awarded in rarest of rare cases.
The court further noted in its order that the investigation in the case by the CBI is in full swing and “it would be injustice flouting the principle of equity to release the accused on bail”, news agency PTI reported.

The body of the 31-year-old woman doctor was found with severe injuries in the seminar hall of the RG Kar Medical College and Hospital on August 9. The Calcutta High Court transferred the investigation of the case from the Kolkata Police to the CBI on a bunch of pleas seeking a court-monitored investigation into the case as well as an investigation into the conduct of the hospital authorities, including the role Ghosh and other officials by a special team of investigating officers. The Supreme Court, which took a suo motu cognisance of the incident, is currently seized of the matter.
The CBI has also arrested Ghosh and his two alleged associates on September 2 for his alleged involvement in the financial irregularities at RG Kar hospital during his tenure as the principal of the institute.
