New Delhi: The Supreme Court has granted bail to former Uttar Pradesh minister Azam Khan and his son Abdullah Azam Khan in a machine theft case, taking into consideration the facts and circumstances of the case, including the period of incarceration undergone by them.
The father-son duo had moved the top court against the Allahabad High Court order refusing to grant them bail in the case.
Apex court set aside High Court order
A bench comprising Justice MM Sundresh and Justice Rajesh Bindal set aside the High Court verdict rejecting their plea seeking bail.
“Taking into consideration the facts and circumstances of the case which include the period of incarceration undergone by the appellants, and that the chargesheet has already been filed, we are inclined to set aside the impugned order and grant bail to the appellants,” the apex court bench said and added, “Accordingly, the impugned order stands set aside and the appellants are granted bail, subject to the terms and conditions which are to the satisfaction of the Trial Court.”
Apex court granted liberty to state to seek cancellation of bail in case of violation of any of the conditions
The top court further said that the trial court shall also impose a condition to the effect that Azam Khan and his son Abdullah Azam Khan shall cooperate with the conduct of the trial till its conclusion and shall not make any attempt to influence or win over the witnesses. It also granted liberty to the state of Uttar Pradesh to seek for cancellation of their bail in case of violation of any of the conditions imposed upon them.
What are the allegations?
The criminal case was registered in 2022 against Azam Khan, his son Abdullah Azam Khan and five others at Kotwali, Rampur on the allegations that they had stolen the road-cleaning machine purchased by the Nagar Palika Parishad, Rampur district and this machine was later recovered from Azam Khan’s Jauhar University of Rampur.
