Prayagraj: The Allahabad High Court, while hearing a maintenance dispute between an elderly couple aged above 75 years, observed that “it appears that Kalyug has arrived.”
Justice Saurabh Shyam Shamshery observed this while hearing a plea filed by 80-year-old husband Munesh Kumar Gupta challenging an order of an Uttar Pradesh family court directing him to pay a maintenance of Rs 5,000 per month to his 76-year-old wife Gayatri Devi.
High Court issued notice to 76-year-old wife on 80-year-old husband’s plea
“It appears that Kalyug has arrived since a couple of aged about 75-80 years is fighting a legal battle against each other for maintenance,” the High Court observed while issuing a notice to the wife on an appeal filed by her husband.
Wife, husband started living separately following a dispute
According to a report in Bar and Bench, the husband and wife have been involved in a property dispute since 2018 and the matter had even reached to the police station, which referred them to a family counselling centre. However, the dispute remained unresolved and the couple started living separately.
The wife later moved the family court seeking a maintenance of Rs 15,000, claiming that her husband was getting a monthly pension of Rs 35,000. The family court awarded the wife a monthly maintenance of Rs 5,000 by the husband.
Parties may come with a settlement on next date, High Court hoped
Aggrieved by the order of the family court, the husband moved the High court and challenged the order awarding his wife Rs 5,000 monthly maintenance.
The lawyer representing the husband raised various arguments before the High Court, which then issued a notice to the opposite party/wife and listed the matter for final hearing on the date fixed in the notice. The judge also hoped that the parties in the case may come with a settlement.
“List on the date fixed in notice at 03.30 PM for final hearing with a hope that parties may come with a settlement,” the High Court said.
