New Delhi: The Supreme Court on Thursday (October 24) dismissed a plea seeking issuance of contempt notice against authorities in Uttar Pradesh, Uttarakhand and Rajasthan for alleged contempt of top court’s order.

The top court had, while hearing plea, stayed the demolition of properties of accused of crimes and had directed authorities not to demolish such properties across the country without its permission.

What did the petitioner say?

The petitioner alleged that properties were demolished by authorities in Haridwar, Jaipur and Kanpur in contempt of the order of the top court staying demolition of properties of accused of crimes without its permission.

A bench comprising Justice BR Gavai, Justice PK Mishra and Justice KV Viswanathan refused to entertain the plea, saying the petitioner was a third party and not directly or indirectly related to the alleged act.

“We don’t want to open a pandora box,” the bench said, adding that it will hear pleas of those affected by the demolition of properties.

Apex court has reserved verdict on pleas against demolition of properties of accused of crimes

The apex court has reserved its verdict on a batch of pleas against demolition of properties of accused of crimes in several states. The petitioners alleged that demolition of properties of several accused in several states were being carried out by authorities in various states without following due procedure of law.

The apex court, while reserving its verdict, had said that its order restraining authorities from demolishing properties of accused of crimes would continue till it decision on the matter.

Apex court earlier put an interim stay on demolition of properties without its permission

The top court earlier had put an interim stay on demolition of properties of accused of crimes without its permission. However, the court had clarified that that its order will not be applicable to unauthorised structures on public roads, public spaces, footpaths etc.

“Till next date there shall be no demolitions without seeking leave of this court. However such order would not be applicable for unauthorised constructions on public streets, footpaths, abutting railway lines or public spaces,” the top court had said in its order.
