New Delhi: The Delhi High Court on Wednesday (December 4) sought the response of several Aam Aadmi Party (AAP) leaders, including former Delhi chief minister Arvind Kejriwal and Manish Sisodia, and Bharat Rashtra Samithi (BRS) leader K Kavitha on a plea filed by the Enforcement Directorate (ED) challenging a trial court order directing it to supply “unrelied documents” to them in en excise policy-linked money laundering case.
The ED has challenged the November order of the trial court directing the central agency to supply the chargesheet and the digitised records of the remaining “unrelied documents” (those documents not used by the prosecution to support its case) to the accused persons in the money laundering case.
Who are accused in the money laundering case?
Besides Kejriwal and Kavitha, former Delhi deputy chief minister Manish Sisodia, AAP Rajya Sabha MP Sanjay Singh and several businessmen are also accused in the money laundering case registered in connection with the alleged irregularities in the formulation and implementation of the now-defunct Delhi Excise Police.
What did ED argue?
The counsel appearing for the ED argued before Justice Manoj Kumar Ohri that the direction by the trial court to supply unrelied upon documents to the accused was given to the agency at the stage of scrutiny of documents, however, as per the directions by the Supreme Court, only a list of unrelied upon documents have to be given to the accused persons at this stage and not the documents.
The high court was informed that the case is fixed for hearing before the trial court on December 21.
High Court issued notice to all 40 accused in money laundering case
The High Court, after hearing submission, issued notices to all the 40 accused persons in the money laundering case on ED’s plea and listed the matter for further hearing on January 30, 2025, news agency PTI reported.
The money laundering case stems from a case registered by the Central Bureau of Investigation (CBI). The central agencies have alleged that irregularities were committed in the formulation and implementation of the now-scrapped Delhi Excise Policy in lieu of kickbacks.
