New Delhi: A city court on Tuesday (November 26) granted the Enforcement Directorate (ED) time till November 28 to file its response on a plea by former Delhi Chief Minister Arvind Kejriwal seeking a copy of the requisite sanction to prosecute him in the alleged excise policy-linked money laundering case.
Kejriwal has moved the court seeking a copy of the requisite sanction to prosecute him, claiming that he has not been served a copy of the sanction and pointing out that the ED, during a hearing before the Delhi High Court on his plea, had stated that it has got the requisite sanction to prosecute him in the alleged money laundering case.
Court adjourned the matter to November 28
Special judge Kaveri Baweja granted time to the ED on a plea filed by the central agency and adjourned the matter.
“Special counsel for ED seeks some time for obtaining necessary instructions and to file reply to the application moved on behalf of Kejriwal. At request, adjourned to November 28, 2024 for filing reply, if any, and arguments on the above said application,” Special judge Kaveri Baweja said, news agency PTI reported.
Kejriwal moved High Court last week challenging trial court order on chargesheet cognisance
Kejriwal, who is the national convenor of Aam Aadmi Party (AAP), had moved the High Court last week challenging the trial court order taking cognisance of a supplementary chargesheet filed by the ED against him. He has sought a direction to set aside the trial court order, submitting that when the alleged offence was committed, he was a public servant and the trial court took the cognisance of the chargesheet in the absence of any sanction to prosecute him in the case. He also sought a stay on the proceedings in the money laundering case before the trial court.
Sanction was obtained to prosecute Kejriwal, Mehta told High Court last week
Solicitor General Tushar Mehta, who had appeared for the ED, had told the High Court during the hearing last week that a sanction was obtained to prosecute Kejriwal and he would be filing an affidavit.
High Court last week refused to stay proceedings before trial court
The High Court refused to stay the proceedings before the trial court and had issued notice to the ED and sought its response on Kejriwal’s plea.
Kejriwal was arrested in the money laundering case by the ED on March 21 and was granted interim bail by the Supreme Court on July 12.
