New Delhi: The Delhi High Court will hear on January 30 next year a plea filed by former Delhi chief minister Arvind Kejriwal challenging a trial court order taking cognisance of a chargesheet filed by the Enforcement Directorate (ED) in a Delhi Excise Policy-linked money laundering case.
The counsel representing the ED sought adjournment of the matter, submitting that Additional Solicitor General SV Raju, who was scheduled to make submissions before the court on Friday, was unavailable.
Justice Manoj Kumar Ohri initially posted the matter for February 19 next year, however, it then fixed January 30 next year after the counsel representing Kejriwal requested for an early date.
Kejriwal’s counsel opposed ED’s request for adjournment
“Here is a person (Kejriwal) whose elections are coming in January and he is waiting endlessly for the other side to argue the matter,” Kejriwal’s counsel said while opposing the request by the ED for adjournment, news agency PTI reported.
The High Court also posted former Delhi deputy chief minister Manish Sisodia’s similar plea on January 30.
High Court earlier refused to stay trial against Kejriwal
Earlier, the High Court, while issuing notice to the ED on Kejriwal’s plea, refused to stay trial against Kejriwal in the money laundering case.
What has Kejriwal submitted?
Kejriwal has sought the direction from the High Court to set aside the order of the trial court taking cognisance of the ED chargesheet, submitting that he was a public servant when the alleged offence was committed and the trial court took cognisance of the chargesheet in the absence of any sanction to prosecute him in the case. He also sought a stay on the proceedings before the trial court.
What has Sisodia submitted?
Sisodia has also sought quashing of the trial court order taking cognisance of the chargesheet filed by the ED, submitting that he was a public servant when the alleged offence was committed and the trial court took cognisance of the ED chargesheet in the absence of any sanction for his prosecution in the case.
