New Delhi: The Delhi High Court on Thursday (February 6) sought a response from the National Investigation agency (NIA) on letting Bramulla Lok Sabha Member of Parliament (MP) Sheikh Abdul Rashid, popularly known as Engineer Rashid, attend the ongoing Parliament session on custody parole.
Justice Vikas Mahajan was hearing a plea filed by Rashid seeking interim bail to attend the Parliament session. The Baramulla MP has sought release on interim bail or custody parole in the alternative to attend the ongoing Parliament session.
Rashid has also filed a plea seeking quick disposal of his bail plea pending before trial court
Rashid has also filed a plea before the High Court seeking a direction for quick disposal of his bail plea pending before a trial court in the in the terror funding case.
What did the High Court say?
“He (Rashid) can, in the meantime, attend the session in judicial custody. He is an elected MP. What is the difficulty in sending him in custody?” asked Justice Mahajan and granted the NIA time till Friday to seek instructions on the issue, news agency PTI reported.
The counsel representing the NIA told the court that the matter was “not that simple” as there was a security issue as well.
The High Court on February 4 issued notice to its registrar general for the clarification on the issue of designation of a court to hear Rashid’s plea seeking bail in a terror-funding case.
What did NIA, Rashid submit earlier?
The NIA opposed Rashid’s plea for interim bail to attend the ongoing Parliament session. It has said that he had no such right as a parliamentarian. Rashid’s counsel submitted before the High Court that he had been left in limbo and without remedy after the NIA court hearing his bail plea sent the matter back on the ground of it not being a special MP/MLA court to hear the matter since he was now a lawmaker.
