New Delhi: The Delhi High Court on Friday dismissed an application of an organisation seeking to become a party to the proceedings over death of three civil service aspirants in the basement of a coaching centre in Old Rajendra Nagar.

A bench comprising Acting Chief Justice Manmohan and Justice Tushar Rao Gedela refused to implead a charitable trust as a party in Public Interest Litigation (PIL), saying the best federal agency – Central Bureau of Investigation – is seized of the matter and interference by third parties may create obstacles in the ongoing probe.

The High Court recently transferred the investigation of the case from the Delhi Police to the CBI while hearing a PIL filed by organisation Kutumb, represented by lawyer Rudra Vikram Singh. The PIL sought a probe by the high-level committee into the incident.
The counsel for the charitable trust ‘Anand Legal Aid Forum Trust’ claimed before the court that the father of one of the students drowned in the basement of the coaching institute had “expressed his eagerness” to him.
The High court, however, pointed out that the plea was filed by a third party and not the parent, and asked the counsel of the chatitable trust to not “exploit” the circumstances.
What did the High Court say while transferring probe to CBI?
The High Court, while transferring the probe to the CBI, slammed the Delhi Police and Municipal Corporation of Delhi (MCD) over death of three civil services aspirants in the basement of a coaching institute following rain, saying it is time to relook at everything, as there is larger malaise in the national capital.
“Having regard to the seriousness of incidents and that it may involve corruption by public servants, this court transfers the investigation to CBI,” the High Court had said and had also directed the Central Vigilance Commission (CVC) to nominate a senior officer to oversee the CBI probe and ensure that the investigation is complete in a time bound manner.”
Three civil service aspirants – Shreya Yadav, Tanya Soni, and Nevin Dalwin – lost their lives after the basement of the IAS coaching building in Old Rajendra Nagar – Rau’s IAS Study Circle – was flooded following rain on the evening of July 27.
