New Delhi: The Delhi High Court on Friday (January 17) refused to extend the interim bail granted to expelled Bharatiya Janata Party (BJP) leader Kuldeep Singh Sengar in the main Unnao rape case and asked him to surrender on January 20 as directed by the court earlier.
Sengar, who was convicted and awarded imprisonment for the remainder of his biological life in main Unnao rape case, sought further extension of interim bail granted earlier by a division bench till January on medical grounds submitting that he was scheduled next week to undergo an eye surgery in AIIMS.
What did the High Court say?
A comprising Justice Prathiba M Singh and Justice Dharmesh Sharma recused from hearing Sengar’s plea seeking further extension of interim bail and directed that the matter be placed before another bench on January 27.
“We are not indulging. You surrender first, we (high court) will consider,” said Justice Singh.
Justice Dharmesh Sharma, as a trial court judge, convicted and sentenced Sengar in the case in 2019.
Sengar has also sought extension of interim bail in connected case
Sengar has also sought extension of his interim bail in connected case of custodial death case of the Unnao rape victim’s father. A single bench had earlier granted him interim bail in the case till January 20, taking into consideration the interim bail granted by the division bench to him in the main Unnao rape case. His plea seeking extension of interim bail is pending before another bench.
Sengar is serving sentence in Unnao main rape case and related case
While Sengar is serving life imprisonment for the remainder of his biological life in main Unnao rape case for raping a minor, he is serving a 10-year imprisonment awarded to him in the case of the death of the father of the Unnao rape victim in custody.
The Unnao main rape case and related cases were transferred to Delhi from the trial court in Uttar Pradesh on the directions of the Supreme Court on August 1, 2019.
