New Delhi: The Delhi High Court on Friday issued notice to the Centre, Delhi government and Tihar Jail authorities on a plea filed by Kashmiri separatist leader Jammu and Kashmir Liberation Front (JKLF) chief Yasin Malik seeking his medical care and asked the Tihar Jail authorities to provide necessary medical treatment to him.
Justice Anoop Kumar Mendiratta, while issuing notices on Malik’s plea, also sought his health status report.
Currently facing a ‘life and death situation’, Malik claimed
Malik, who was awarded life sentence in a terror funding case in 2022, in his plea before the court has claimed that he is a patient of serious cardiac and kidney ailments and currently he is facing a “life and death situation” and that he was a political figure and his requests of a proper health investigation was declined by authorities.
Malik claimed in his plea that “there had been occasions when the petitioner was seriously ill or his presence was mandatorily required before the trial court, but in the garb of (section) 268 of CrPC (Code of Criminal Procedure )orders (restricting Malik to Tihar Jail and Delhi), he was neither taken to the hospital nor produced in courts” and “aggrieved from the malafide and negligent acts of the respondents, the petitioner has been suffering rash, irregular treatment and weight loss and every organ of the petitioner has been vulnerable.”

Malik’s counsel told the High Court that his client was on hunger strike since November 1 and required an urgent hospital admission.
“Issue notice. Let medical status report of the petitioner be called from the jail superintendent. Further, keeping in perspective the submissions made by the counsel for the petitioner, superintendent jail is directed to ensure that necessary medical treatment is provided to the petitioner in accordance with the jail rules,” the court ordered, news agency PTI reported.
Malik had earlier also moved the High Court seeking medical treatment and the court had disposed of his petition after necessary medical care was extended to him following his examination by doctors at AIIMS.
Malik was awarded life sentence in a terror funding case in 2022
Malik was awarded life sentence by a trial court in the terror funding case on May 24, 2022 after he pleaded guilty to the charges, including those under anti-terror law Unlawful Activities (Prevention) Act (UAPA). The trial court held him guilty of various offences under the UAPA and Indian Penal Code (IPC). The National Investigation Agency (NIA) has challenged the trial court order before the High Court and has sought death penalty for him.
The matter has been listed for further hearing on November 11.
