New Delhi: A city court on Tuesday (January 7) extended the interim stay on the attachment of Rajasthan’s Nokha municipal council-owned Bikaner House.
District judge Vidya Prakash extended the stay on attachment of Bikaner House, which is located in national capital’s prime locality, after being informed by Nokha Municipal Council that it had challenged in the Delhi High Court the order directing it to deposit an arbital award it owed a company.
The municipal council informed the court that it had deposited Rs 92.24 lakh, it reportedly owed the company, before the court, news agency PTI reported.
District court earlier on November 29 last year stayed its order
The district court earlier on November 29 last year stayed its order on the attachment of Bikaner House.
While ordering the stay on attachment, the judge said that a 2020 arbitral award in favour of Enviro Infra Engineers Private Limited had attained finality after municipal council’s appeal was dismissed in 2024.
The judge had in November, 2024 granted a conditional stay on the attachment, subject to the municipal council depositing an FDR before the court.
Court order came on a plea seeking enforcement of arbitral award
The court earlier on September 18 last year, while noting the non-compliance of the directions of the court, had ordered the attachment of the Bikaner Hose. The court’s order came on a plea seeking enforcement of the arbitral award passed by an arbitral tribunal on January 21, 2020.
What did the court say while ordering attachment of Bikaner House?
“Keeping in view the fact that the Judgement Debtor (JD) had failed to comply with the direction for furnishing affidavit of their assets despite grant of repeated opportunities, the court, while agreeing with the submissions made on behalf of Decree Holder (DH), finds it a fit case for issuance of warrants of attachment against immovable property of JD namely Bikaner House, New Delhi,” the judge had said in September 18 last year order.
