New Delhi: The Delhi High Court has granted bail to the co-owners of the basement of a coaching centre in Old Rajendra Nagar where three civil services aspirants drowned in July last year.
Justice Sanjeev Narula granted bail to Parvinder Singh, Tajinder Singh, Harvinder Singh and Sarbjit Singh, who were out on interim bail in the case, agreeing with their submissions that their role was limited to being the owners of the property where the incident occurred.
What did the High Court say?
“On a prima facie view, find merit in the contention (of the co-owners) that the role of the applicants was limited to being owners of property where the incident occurred. Moreover, the investigation regarding the aspect of corruption, is stated to be pending on the end of the CBI,” the High Court said.
The High Court further said that no material was placed on record either in the status report or otherwise to indicate an angle of corruption against the co-owners and it was a fit case for relief to them.
“Accordingly, the order dated September 13, 2024, granting interim bail (building co-owners) is now confirmed as regular bail on the same terms and conditions,” the High Court said.
The High Court also said that the allegation against the co-owners is that they let out the basement for commercial purposes which was not permissible, however, whether the same amounts to an offence under sections 105 and 106 of the BNS is for the trial court to decide based on evidence.
Three civil services aspirants lost their lives on July 27 last year
Three civil services aspirants – Shreya Yadav, Tanya Soni and Nevin Dalwin – drowned in the basement of Rau’s IAS Study Circle coaching centre in Old Rajendra Nagar after the basement of the coaching centre was flooded following rain in the evening of July 27 last year.
The High Court had on August 2 last year transferred the investigation of the case from the Delhi Police to the CBI.
Trial court took cognisance of CBI chargesheet on December 4 last year
The trial court on December 4 last year took cognisance of a chargesheet filed by the CBI against six accused persons in the case, saying there was sufficient evidence to proceed against them.
