New Delhi: The Delhi High Court on Thursday issued notice and sought the response of the Central Bureau of Investigation (CBI) on the bail pleas filed by four jailed co-owners of the basement of a coaching centre in Old Rajendra Nagar where three students lost their lives after drowning.

Justice Dinesh Kumar Sharma, while issuing the notice to the CBI on the bail pleas of co-owners of the basement of the coaching centre – Parvinder Singh, Tajinder Singh, Harvinder Singh and Sarbjit Singh — remarked, “The incident was very unfortunate.”

Senior advocate Mohit Mathur, who appeared for the co-owners of the coaching centre basement stated before the High Court that the incident was indeed “sad” but asserted that the co-owners had merely leased the basement and another floor of the building to the coaching centre and they cannot be held liable for the deaths of three students.
High Court earlier transferred investigation of case from Delhi Police to CBI
The case was initially being probed by the Delhi Police, which had registered a case under various sections of the Bharatiya Nyaya Sanhita (BNS), including section 105 (culpable, including homicide not amounting to murder). The Delhi High Court, while hearing a Public Interest Litigation (PIL) seeking investigation into the incident by a high-level committee, transferred the investigation of the case from the Delhi Police to the CBI.
The co-owners of the basement of coaching centre RAU’s IAS Study Circle have moved the High Court challenging a trial court order dismissing their bail pleas, saying that the probe by the CBI into the incident was at an initial stage and their specific role had to be ascertained.
“The issue of violation of building bye-laws and encroachment over the drainage system needs to be investigated and the specific role of the applicants needs to be ascertained,” the trial court said while rejecting the bail pleas of the co-owners of the coaching centre basement.

The four co-owners of the coaching centre basement and the owner and coordinator of the coaching centre are currently lodged in judicial custody in the case. The court earlier remanded the six persons to four-day CBI custody.
Shreya Yadav, Tanya Soni, and Nevin Dalwin – drowned in the basement of the coaching centre after the basement was flooded following rain in the evening of July 27 and the three civil services aspirants lost their lives.
