Budaun: The hearing in a plea filed by a Hindu outfit seeking permission to offer worship at Jama Masjid Shamsi in Nudaun claiming it to be a Ndeelkanth temple could not be held today before the local court and the matter will now come up for hearing on December 17.
Civil Judge (Senior Division) Amit Kumar Singh had earlier on December 3 directed the Muslim side to complete its arguments by December 10 on the Hindu side plea claiming that the Neelkanth Mahadev temple existed at the mosque site.
The hearing in the matter could not be held on Tuesday before the Budaun court due to the death of a lawyer of the court and it will now come up for hearing on December 17, advocate Asrar Ahmed, representing the Shamsi Shahi Jama Masjid Intezamia Committee and the Waqf Board told news agency PTI.
Akhil Bharat Hindu Mahasabha has filed a petition before the Budaun court
Akhil Bharat Hindu Mahasabha, a Hindu outfit has filed a plea before the Budaun court claiming that the Neelkanth Mahadev temple existed at the mosque site. It further said that the Neelankant temple in the fort of King Mahipal was demolished by the ruler of the slave dynasty and invader Shamsuddin Iltutmish and it was converted into the mosque.
What did the Muslim side say earlier?
The counsel appearing for the Shamsi Shahi Jama Masjid Intezamia Committee and Waqf Board earlier questioned the locus standi of the Akhil Bharat Hindu Mahasabha to file the plea before the court in the matter and urged the court to dismiss the plea. The counsel submitted that the Akhil Bharat Hindu Mahasabha does not have the legal right to become a plaintiff in the matter and filing such a plea before the court violates the Places of Worship Act, 1991.
There is no existence of a temple at mosque, Muslim side earlier told court
The counsel representing the Muslim side had further submitted before the court that the said mosque is about 850 years old. The counsel further submitted that there is “no existence of a temple” at the place and worship by Hindus in the mosque had never been conducted in the past.
