Allahabad HC refuses to grant bail to a man accused of unnatural sex with cows

Prayagraj: The Allahabad High Court recently refused to grant bail to a person accused of committing unnatural acts with the cows in a cowshed, noting that the act is confirmed from video footage as well as the medical report of the chief veterinary officer.

What did the High Court say?

“Considering the facts that the applicant (accused) has committed an unnatural acts with the cows in the cowshed, which is confirmed from the video footage as well as from the medical report of the chief veterinary officer and more particularly, no new ground has been taken by the counsel for the applicant in the instant bail application, without expressing any opinion on the merit of the case, I do not find it to be a fit case for granting bail,” Justice Piyush Agrawal said while rejecting the second bail application of the accused.

A case under section 377 (unnatural sex) of the Indian Penal Code (IPC) was registered against the accused in Hapur district’s Hapur Nagar police station.

Prosecution opposed the bail plea of the accused

The prosecution opposed the bail plea of the accused, submitting that the accused has committed an unnatural acts with the cows in the cowshed, which is confirmed by the video footage and the video received through WhatsApp on the mobile of witness in which the accused is seen committing the unnatural acts with the cows.

Accused is innocent, falsely implicated in case: Counsel

The accused, however, submitted before the High Court that he is innocent and has been falsely implicated in the present crime. The counsel representing the accused further submitted that the informant with collusion of his supporter lodged this present case against the present applicant after delay of two days to defeat the present gram pradhan (Head of village) and indirectly targeted gram pradhan, because the applicant belongs to the family of present gram pradhan.

The counsel for the accused further submitted that no witness was examined at the time of hearing the first bail application, but now four witnesses have been examined, who have not supported the case of the prosecution and declared hostile. The counsel further submitted that the applicant is in jail since June 20, 2023 and the possibility of conclusion of trial in near future is very bleak.

The High Court, however, rejected the submissions of the accused and refused to grant bail to him.

“The second bail application is rejected,” the High Court said.
