New Delhi: The Central Bureau of Investigation (CBI) on Friday told the Delhi High Court that its appeal against the trial court order acquitting former telecom minister A Raja and 16 others in the 2G spectrum allocation case was “ripe for hearing”.
The CBI counsel urged Justice Vikas Mahajan to either fix multiple dates to hear the appeal against acquittal or post it on another date to decide a hearing schedule.
“The matter is ripe for hearing. I request the court to give a bouquet of multiple dates,” senior advocate Sanjay Jain appearing for the central agency said.
Justice Mahajan posted the matter for hearing on March 18, news agency PTI reported.
Trial court acquitted former telecom minister Raja, others
The CBI has moved the High Court against a verdict of a special CBI court, which acquitted former telecom minister and sitting Nilgiris MP Raja, DMK MP Kanimozhi and others in the CBI and Enforcement Directorate (ED) cases stemming from the alleged 2G spectrum allocation scam.
The CBI moved the high court against the acquittal by the trial court on March 20, 2018.
High Court admitted CBI’s appeal against trial court order in March last year
The high court on March 22 last year admitted the appeal of the CBI, saying there were “some contradictions” in the judgment of the trial court requiring a “deeper examination”.
“The court on the basis of material on record, and after going through the sworn testimonies, material on record, impugned judgment and the submissions made at bar by both the parties has reached on an objective satisfaction that there is a prima facie case which requires deeper examination and re-appreciation/re-appraisal of entire evidence,” the High Court said.
High Court is also seized of an appeal filed by ED against acquittal
The High Court is also seized of an appeal moved by the ED against the trial court verdict acquitting accused persons and firms in the alleged 2G spectrum allocation scam case.
