New Delhi: Aam Aadmi Party (AAP) MLA Naresh Balyan on Tuesday (January 28), while referring to Supreme Court order granting custody parole to former councillor and Delhi riots accused Tahir Hussain, urged the Delhi High Court to release him on custody parole for six hours.
Balyan counsel submitted before Justice Vikas Mahajan that he is a two-time sitting MLA and a “significant member” of AAP and his wife, who does not have any experience, was contesting polls.
Balyan relied on apex court order allowing custody parole for Hussain
Balyan’s counsel, who sought permission for custody parole while arguing for bail in a case lodged under the stringent Maharashtra Control of Organised Crime Act (MCOCA), relied on the Supreme Court order, which today allowed Hussain to campaign for the Delhi assembly elections in custody parole from January 29 to February 3.
“There is no offence made out against me (Balyan). Custody parole may be granted. There will be no impediment since I will be in custody. I will not give a statement to the media. I am a two-time sitting MLA,” Balyan’s counsel told the High Court and suggested that his custody parole could even be videographed.
High Court asked Delhi Police counsel to seek instructions
The High Court, while hearing the submissions made by Balyan’s counsel, asked the Delhi Police counsel to seek instructions and posted Balyan’s plea for hearing on January 29.
“Seek instructions and come. One day he can go and align things for his wife,” the judge said, news agency PTI reported.
The counsel representing the Delhi Police told the court that it was Balyan’s wife who was contesting the polls and not accused Balyan against whom investigation is underway.
The Delhi Police earlier opposed Balyan’s plea for interim bail in view of the Delhi assembly elections on February 5.
The trial court earlier denied bail to Balyan in the case.
Balyan was arrested in MCOCA case on December 4
The Delhi Police arrested Balyan in the case on December 4 last year while he was in police custody in another case – an alleged extortion case. He was granted bail by the court in the extortion case on December 4 last year.
